Having begun his career litigating large, complex commercial matters in both state and federal court, over the years Mr. Stein has frequently been requested to serve as an arbitrator hearing similar cases, including international disputes. His practice is now exclusively devoted to serving as a neutral arbitrator.

Mr. Stein has chaired arbitration panels that have heard disputes between parties from various countries located in Africa, Europe, and Asia, as well as North and South America. The amount in dispute in the international arbitration cases in which Mr. Stein has participated as an arbitrator has ranged from between $1 million and $100 million dollars. Mr. Stein is listed on the American Arbitration Association’s (International Centre for Dispute Resolution) Panel of International Arbitrators and has been selected by the AAA to be a member of its faculty that trains its National Commercial Panel. In addition, the Florida Bar and the AAA jointly requested Mr. Stein to teach an International Arbitration seminar at the Florida Bar’s annual convention. In December 2005, at the invitation of the Conference of Florida State Court Trial Judges, Mr. Stein taught the State’s Circuit Court judges issues related to the interaction between the courts and the arbitration process. In addition, he frequently lectures on emerging issues in commercial arbitration.

A partial list of the types of cases in which Mr. Stein has served as an arbitrator includes, but are not limited to:

 reinsurance and insurance industry matters;
 accounting and legal malpractice;
 commercial contract disputes including: procurement agreements; international joint ventures, international and domestic franchise arrangements; business and asset acquisition contracts; non-competition and confidentiality agreements; employment contract; and real estate development and acquisition agreements;
 securities industry arbitrations;
 probate-related disputes; and
 intellectual property disputes in the computer, telecommunications, and other manufacturing industries.

The legal issues addressed include a wide range of problems such as the application of trade laws to commercial arrangements, fraud, and the alleged failure to comply with a variety of contractual terms.

Mr. Stein also serves as the General Counsel to the Consul General of Japan in Miami and the Florida Delegation to both the Southeast U.S.-Japan Association.

  • As an arbitrator, and one

    As an arbitrator, and one who handles real estate disputes, this article is right on target. I would suggest, however, that if arbitration has been included in your contract for purchase and sale, if not also already included in your contract, you should, "up front," adopt a set of Rules that best suits your dispute. In addition, I highly recommend that any such dispute be administered by a reputable arbitration institution. The most reputable organization is the American Arbitration Assocciation ("AAA"). Their website can be accessed at www.adr.org. The AAA has three sets of Arbitration Rules that could apply to a real estate dispute. The first set is the Real Estate Industry Rules. The second is the AAA's Rules of Commercial Arbitration. The third only comes into play if one of the parties is not a U.S. citizen, or is a foreign corporate entity. Then the dispute would be administered by the International Centre for Dispute Resolution ("ICDR"), which is the AAA's division that is devoted solely to international arbitrations. The Rules that would then govern your dispute would be the ICDR's International Arbitration Rules. There are two other "for-profit" arbitration institutios that offer an alternative to the AAA. The first is the National Arbitration Forum ("NAF"). Their website is www.adrforum.com. The second is JAMS. I believe their website is www.jamsadr.com.
